Judgement reserved..... for eternity....!


Do we still believe in getting the judgments pronounced for long-pending cases within a reasonable time? Highly doubtful. Why is it that in our country, the judgments for all court cases are getting dragged indefinitely? Is it due to lack of number of courts? Lack of sufficient count of judges? Is it the improper system? Unwillingness on every stake-holder's part? The net result is that the judgments will never be given in reasonable time. It is an unpalatable fact!

This inordinate delay has a cascading effect and the number of pending cases pile up to unmanageable levels. Is anyone bothered about this sad state of affairs? May be only the victims!! Take for example, the Nirbhaya case. The crime took place in 2012 and this is 2020. Surprisingly the perpetrators of the heinous crime lived up to 20th March 2020. Though 'death sentence' was passed within a year of the time of the crime, it was more than 7 years later, the actual hanging was carried out. The hanging date got postponed every now and then. I think we should fault the system, in this case. (After all the loopholes in the law were exhausted, the hanging took place on 20th March, 2020).

It is in this context that when the rapists were killed in a police encounter recently in another case, the people rejoiced. The common people are frustrated by the mindless postponements of the execution. They are suspicious whether the actual sentence will be carried out or not. Is it not the responsibility of the government and the courts to infuse confidence in the ordinary citizens of this country about judiciary? To add fuel to fire, the so-called 'human rights people' throw their hat and prolong the execution of any sentence. They are worried and concerned only about the criminals and not the victims. They fail to think that the victims are also human beings.

We can quote innumerable cases where the hearings are adjourned in every court appearance. But why? Though the system might argue that due opportunities should be offered to the accused to prepare and present their cases, there is a limit for everything. They can stipulate that no more than 'x' number of adjournments in any particular case could be given. And any case, after it is filed, should be given the verdict in 'y' number of months and execution takes place within 'z' number of days.

There are countless number of cases wherein the 'swindled' money to the tune of billions of dollars that are pending in various courts throughout the country. Why are the accused allowed to go 'scotfree' getting bails, the bail period running to several years? What prevents the courts decide and give the final verdicts in the cases? After all, it is the tax-payers money that they have siphoned off. There are so many questions to ask!! But unfortunately, there are no plausible answers....
